POPIA / Data Protection Policy

Driver Check is committed to handling personal information responsibly and in accordance with South Africa’s Protection of Personal Information Act, 4 of 2013, commonly known as POPIA.

This policy explains how we approach the protection of personal information in relation to our website, trial requests, client communication and incident reporting service.

Driver Check is a service operated by Driver Management Solutions.

  1. Our approach to personal information

We collect and process personal information only where it is reasonably necessary for legitimate business, operational, service, reporting or legal purposes.

We aim to process personal information lawfully, fairly and transparently.

  1. Types of personal information processed

Depending on the interaction, Driver Check may process:

  • names and surnames;
  • company names;
  • email addresses;
  • phone numbers;
  • fleet and vehicle details;
  • incident report details;
  • caller details where provided;
  • date, time and location information;
  • communication records;
  • information required for account, billing, support or reporting purposes.
  1. Purpose of processing

We process personal information to:

  • respond to enquiries;
  • manage trial requests;
  • activate and support clients;
  • receive and log road-user incident reports;
  • notify clients of reported incidents;
  • prepare monthly incident summaries;
  • maintain service records;
  • improve service quality;
  • meet legal or regulatory obligations where applicable.
  1. Incident reports and responsible use

Incident reports may contain information about vehicles, drivers, callers and reported events.

Clients receiving incident reports are responsible for using the information lawfully, fairly and appropriately. Reports should be reviewed in context and should not be treated as final proof of misconduct without proper internal review.

  1. Lawful processing

Driver Check aims to process personal information in accordance with the lawful processing conditions set out under POPIA.

These include responsible handling, purpose-specific collection, limiting unnecessary processing, keeping information accurate where possible, applying security safeguards, and allowing data subjects to exercise their rights where applicable.

  1. Data subject rights

Where applicable, individuals may request:

  • confirmation of whether Driver Check holds personal information about them;
  • access to personal information held about them;
  • correction of inaccurate or outdated personal information;
  • deletion of personal information where legally appropriate;
  • objection to certain processing where permitted by law.

  1. Security safeguards

Driver Check takes reasonable measures to protect personal information against unauthorised access, loss, misuse, disclosure, alteration or destruction.

These measures may include access controls, secure systems, controlled communication processes, staff awareness and service provider safeguards.

  1. Sharing personal information

We may share personal information where necessary with:

  • authorised staff or representatives;
  • clients receiving reports relating to their registered vehicles;
  • service providers involved in hosting, email, SMS, forms, communication or support;
  • legal, regulatory or law enforcement bodies where required.

We do not sell personal information.

Personal information is retained only for as long as reasonably required for service, reporting, legal, operational, dispute resolution or record-keeping purposes.

  1. Cross-border processing

Some service providers used for website hosting, email, analytics, forms or communication may process information outside South Africa. Where this applies, we aim to use reputable providers and reasonable safeguards.

The Information Regulator is the South African authority empowered to monitor and enforce compliance with POPIA.
